MARY SPENDLOVE LEASE 1673

WITNESSETH That the said Countesse for and in consideracion of the sume of Twenty six poundes of Lawfull money of England in the name of a fyne in hand paid to the said Countes or her Assignes at or before the Ensealeing and Delivery of their Presents And for and in Consideracion of the yearely Rents and Covenants hereafter specified and by their presents reserved to be paid and performed And for other good Consideracions here thereunto Especially moveing HATH demised, granted, sett and to Farme Lett And by their presents doth Demise grant sett and to Farme Lett unto the said Mary Spendlove her Executors, Administrators and Assigns all that Messuage and Tenement with the Land meadow and Pasture grounds thereunto belonging (Late Thomas Spendlove) And alsoe all those Three Closes called the Mott Closes (Late part of Thomas Wingfields Farme) All which premises are sytuate, Lyeing and being in Shottle Parke aforesaid And now in the Tenure or Occupation of her the said Mary Spendlove or her Assignes Together with all Houses, Buildings, Barnes, Backsides, Gardens, Orchards, Lands, Closes, Pastures, Water, Waterings, Easements, Commons, Comodityes and Appurtenances thereunto belonging or in any was appertaineing EXCEPT and alwaies reserved out of this present Demise All woods and underwoods, Timber Trees and Trees whatsoever And all Mines and Quarries whatsoever now or hereafter to be growing, standing found or being in or upon the premises or any part thereof with free Liberty of Ingresse, Egresse or Regresse to and for the said Countes her heires or Assignes at reasonable and convenient Times to fell cutt downe, dig, gett, stack and Carry the same at their owne wills and pleasures TO HAVE AND TO HOLD The said Messuage or Tenement with Land, meadow and Pasture Ground belonging to the same And the said Three Closes called the Mott Closes and all and singular other the Demised premises with the Appurtenances and every part and parcel thereof (Except before Excepted) unto the said Mary Spendlove her Executors, Administrators and Assignes from the feast day of St. Martin the Bishop in Winter [11th Nov.] which shall be in the yeare of our Lord god one Thousand six hundred seventy three for during and untill the Full end and Terme of one and Twenty yeares from thence next ensueing and fully to be compleat and ended YEELDING AND PAYEING therefore yearely and every yeare during the said demised Terme of one and Twenty yeares unto the said Countes her heires, Executors, Administrators and Assignes the yearely Rent or sume of Eight pounds Four shillings of good and Lawfull money of England at the Feast dayes of the Nativity of St. John the Baptist [24th June] and St. Marting the Bishop in Winter [11th November] by even and equall porcions AND if it shall happen the said yearely Rent of summe of Eight poundes Four shillings or any part thereof to be behind or unpaid by the space of Twenty dayes next after either of the said Feasts or dayes of Payment whereon the same ought to be paid as aforesaid being Lawfully demanded That then and from thenceforth it shall and may be Lawfull to be for the said Countess the heires and Assignes or any of them Into the said demised premises or any part thereof in the name of the whole to Renter And the same to have again Repossesse and Enjoy as in her or their former Estate anything herein Contained to the Contrary thereof in any wise not withstanding AND the same Mary Spendlove for herselfe her heires, Executors, Administrators and Assignee and every of them Both Covenant promise grant and agree to and with the said Countes her heires and Assignes and every of them by their presents in manner and forma following viz: That she the said Mary Spendlove her heires, Executors, Administrators or Assignee shall and will yearely and every years during the said demised Terms of one and Twenty yeares pay or cause to be paid the said yearely Rent or some of Eight pounds Four shillings at the Dayes of payment and in manner aforesaid according to the true purport Intent and meaneing of their presents AND alsoe shall and will att her and their owns proper Costs and Charges from time to time during the said demised Terms when and as often as necessary shall require well and sufficiently repairs, uphold, maintains and keep All the Houses, Buildings, Barnes, Mounds, Hedges, Trenches, Ditches wall and Fences in about and belonging to the premises with all needful and necessary reparation And at the end or sooner Determination of the said demised Terms shall and will Leave and yeeld up the same and every part thereof in good and Tenantable repairs AND also shall and will yearely and every years during the said demised Terms sect or plant in and upon the premises in places Convenient and at seasonable Times in the years Ten plants or young Trees of Ash, Oake or Elme and the same soe planted shall nourish up together with the Woods and Trees now or hereafter to be in or upon the said premises end preserve them from destruction. And shall not nor will Lopp, Cutt down decay or destroy the same or any part thereof but for necessary repaires of the fences belonging to the premises. And if the said Trees or any of them shall happen to dye or be spoyled or not prosper then shee or they shall remove the same and plant new Trees in their roomes [places] from Time to Time and nourish up and preserve them from destruction during all the said demised Terms. AND alsoe shall and will at all Times Grind and shell or cause to be Ground and shelled at the Water Corns mills of the said Countes in Posterns in the county of Derby aforesaid All the Corns, Grains, Gritts and Oates which she or they shall spend use or make into Cereals upon the premises during all the said demised Terms AND alsoe shall and will yearely Lay and bestow in and upon the premises in an orderly and Husbandly manner, All the Muck soyle Compost and Manure which she or they shall have or make ariseing from the premises during all the said Demised Terms AND shall not nor will stop up, hinder or Interrupt the usuall accustomed or now settled Wayes or passages into out of or Through the premises or any of them during all the said demised Terms AND shall not or well Alien, Lett, sett or Assigns over the premises or any part thereof to any person or persons whatsoever during the said demised Terms for above the space of Three yeares together without Licence in writeing under the hand and seale of the said Countess her heires or Assignes or officers for the Time being fast had and obtained. AND alsoe shall and will from Time to Time and at al1 times thereafter during the said demised Terme att her and theire owne proper costs and Charges, pay, bear and Discharge All and all manner of Taxes, Levies, and Assesments whatsoeverto the Kings Majestie, Church, Poore, Gaole, Hospital, BridgesAnd the one Moiety or halfe of all Extraordinary Parliament of Military Land Taxes or Assessments which shall be imposed upon the premises or any part thereof AND the said Countes for her selfe her heires and Assignes and every of them doth Covenant promise grant and agree to and will the said Mary Spendlove her Executors, Administrators and Assignes and every of them by their presents That she the said Mary Spendlove her Executors, Administrators and Assignes shall and may from Tyme to Tyme and ail Times hereafter during the said Terme of one and Twenty yeares hereby Demised And under the Rents and Covenants herein mencioned peaceably and quietly have hold use, occupy, possess and Enjoy All the said Messuage and Tenement with Land, meadow and Pasture Ground belonging to the same And the said Three Closes called Mott Closes and all singular other the premises hereby Demised with the Appurtenances and every part and parcell thereof (Except before Excepted) without the Lawfull Lett, suit Trouble, Incumbrance, Evicion, Molestation ordisturbance of her the said Countes her heires or Assignes orany of them or of any other person or persons whatsoever, haveing or Lawfully Claimeing or which [hidden under fold ofdocument] hereafter shall have or may Lawfully Claime any i'or under her or them their or .........................
