The Last Will and Testament of Joesph Spendlove
late of Wakebridge in the Parish of Crich in the County of Derby
but now of Hill Top in the Parish of South Wingfield in the County of Derby
Yeoman made the twentysixth day of July in the Year of our Lord one thousand
eight hundred and fifty eight in manner following, that is to say, First
I Will and Direct that all my just debts and funeral and testamentary expenses
be fully paid and discharged as soon as conveniently may be after my decease.I
Give and bequeath the sum of fifty pounds unto and equally divided between
and amongst all and every the children of my sister Ann Argile whether
now born or hereafter to be born share and share alike and which said Legacy
I Direct shall be paid and payable to them when and as they shall severally
attain the age of twentyone years .I Give and Devise my messuages buildings
Lands herediaments situate in Crich now in the several occupations of Benjamin
Taylor Lesson and Samuel Bower and which I purchased from Mr
Saxton and all other my messuages Lands and herediaments except my several
pieces or parcels of land situate and being at Brassington in the
said County of Derby hereinafter mentioned.And also all my
personal Estate and Effects unto my Brother Robert Spendlove his heirs
executors and administrators Upon trust to sell and dispose thereof in
such way and manner as he or they may deem most expedient and advantage
and of the monies arising therefore to pay and discharge all my just debts
funeral and testamentary expenses and the said Legacy of fifty pounds herinbefore
by me bequeathed and the surplus ( if any ) I Give and bequeath unto the
said Robert Spendlove absolutely .I Give and Devise all those my several
pieces or parcels of Land situate and lying and being at Brassington
aforesaid unto my said Brother Robert Spendlove to hold the same unto the
said Robert Spendlove until his eldest Son John Spendlove shall attain
the age of twenty one years and when and as soon as he shall attain that
age upon Trust that he the said Robert Spendlove his heirs Executors or
administrators do and shall sell and dispose thereof in such way and in
manner as he or they shall deem most advantageous and do and shall pay
and divide the monies ariseing from such sale unto and equally between
and amongst all any every the children of the said Robert Spendlove now
born or hereinafter to be born share and share alike when and as
they shall severally attain the age of twenty one years .And lastly I appoint
the said Robert Spendlove Sole Executor of this my Will . And I declare
that the receipts of the said Robert Spendlove his heirs executors or administrators
shall exonerate purchasers and others paying monies to him or them under
the trusts of this my Will. And that he and they shall not be answerable
for involuntary lapse in the execution of the trusts hereby in them and
them reposed.As Witness my hand the day and year above written.

us who present at the same time and in his presence and in the presence
of each other have hereunto subscribed our names as witnesses.

On the 16th day of September 1858 the Will of Joseph Spendlove late
of Hill Top in the Parish of south Wingfield in the County of derby Yeoman
deceased was proved by the oath of Robert spendlove the Brother of the
deceased the sole Executor named therein,having first sworn duly to administer.
