The last Will and Testament of THOMAS SPENDLOVE the Elder of the Crow Trees in the parish of Duffield in the County of Derby, Farmer made the 6th day of April 1843 in manner following, that is to say I give and devise unto my Son THOMAS SPENDLOVE his heirs and assigns, all that messuage farm or tenement with the several pieces or parcels of Land thereto belonging, situate in Hazlewood in the parish of Duffield aforesaid and now in the occupation of my Son JOB SPENDLOVE; Upon trust nevertheless that the said THOMAS SPENDLOVE his heirs or assigns do and shall at such time after my decease, as he or they may deem most expedient and advantageous shall and (?) absolutely dispose of the said messuage farm lands and hereditaments, either by public auction or private contract, for the best price that can be reasonably obtained for the same, with power to buy in the same hereditaments at any public auction, and afterwards to resell the same without being answerable for any demination in the value on such second sale.

And I do hereby declare that the receipt or receipts of the said THOMAS SPENDLOVE his heirs or assigns, for the monies to arise by such sale as aforesaid shall be a sufficient discharge to the purchaser or purchasers of the said hereditaments and premises, who shall (????wise) be bound to see to the application of such purchase monies or be answerable or accountable for any losses or misapplication thereof. And I hereby do further declare my Will to be that the said THOMAS SPENDLOVE his heirs, and assigns shall Hand and to possesser of the monies to arise by such sale as aforesaid. Upon the Trusts following namely, Upon Trust in the first place to pay thereout all costs, charges and expenses attending such sale or otherwise incurred in the execution of the trusts of this my Will and all financial fees now payable to the Lord or Steward of The Manor of Hazlewood for the admission of the said THOMAS SPENDLOVE his heris and assigns to the said hereditaments upon the trust of this my Will, and then upon trust to pay and discharge the principal sum of £250 now due and owing on Mortgage or other security of the said hereditaments and premises, or some part thereof, together with all Interest that shall be then due and owing for the same (and which said sum of

£250 I lately borrowed for the use and benefit of my said Son JOB SPENDLOVE) and as for said concerning all the residue of the said monies, Upon trust to place the same out at Interest on good and sufficient security or securities and to pay the Interest dividends and proceeds thereof from time to time unto my said Son JOB SPENDLOVE and to his Wife MARY SPENDLOVE during their joint natural lives and to the survivor of them during his or her natural life, and from and after the decease of the survivor of the said JOB SPENDLOVE and MARY his wife, Upon trust to pay unto LUCY SPENDLOVE, MARY SPENDLOVE and SUSANNAH SPENDLOVE the 3 Daughters of the said JOB SPENDLOVE the sum of

£50 apiece and to pay and divide all the residue of the said monies unto and equally amongst,THOMAS SPENDLOVE, JOB SPENDLOVE and JOHN SPENDLOVE the 3 Sons of my said Son JOB SPENDLOVE share and share alike. And I give and bequeath unto my said 3 Grand Daughters beforenamed the further sum of £50 apiece to be paid to them out of the estate and effects hereinafter described and bequeathed to my said son THOMAS SPENDLOVE on their respectively attaining the age of 21 years, but without any interest in the meantime. And I GIVE AND BEQUEATH UNTO MY daughter SUSANNAH BEARDSLEY the sum of £200 which said Legacies I direct shall be paid at the end of 12 Months from the time of my decease but without interest. And subject to the payment of all my just debts except the said debt of £250 contracted for the use of my said Son JOB SPENDLOVE, together with the Interest that shall be due at the time of the payment thereof, my financial and testamenatary expenses and the said several last mentioned legacies to my Grand Daughters and Daughter, I give devise and bequeath all my Personal Estate and effects and all my real estate not hereinbefore devised to my Son

THOMAS SPENDLOVE his heirs executors administrators and assigns for ever. And appoint him the said

THOMAS SPENDLOVE sole Executor of this my Will hereby revoking all former Wills by me at any time heretofore made.

Thomas the Elder who made this will, was married to Susannah Key at Duffield on the 8.10.1788, Susannah died in 1808 aged 49 years.

They had the following Children:-

Lucy Bp. Turnditch 31.5.1789 and died 22.7.1803 grave in Duffield Church Yard

Susannah Bp Turnditch 11.2.1805 who married 17.6.1824 at Duffield William Beardsley

Thomas who married 3.10.1816 at Duffield Anna Annable

Job who married 17.2.1816 at Duffield Mary Willatt
